These Terms are a translation of the Spanish original. In the event of any discrepancy or conflict of interpretation, the Spanish version shall prevail.

1. Parties and purpose

These General Terms and Conditions of Booking (hereinafter, «the Terms») govern the distance booking and contracting of the activities offered by ERROA EXPERIENCE, S.L., NIF B88739545, with registered address at Lapuebla Errepidea 5, Pabellón 11 — 01300 Laguardia (Álava), Spain, trading under the commercial brand LAGA Rioja (hereinafter, «LAGA» or «the organiser»), through the website https://lagarioja.com and the other booking channels made available (telephone, email or messaging).

The activity consists of a guided buggy tour along authorised tracks and trails in Rioja Alavesa and Rioja Alta, with interpretive stops of scenic, cultural and gastronomic interest, and a closing tasting of local produce. It is not a competitive activity or a sport driving activity.

Making a booking implies express and unreserved acceptance of these Terms, of the Legal Notice and of the Privacy Policy. The customer declares that they are of legal age and have the legal capacity to enter into a contract.

These Terms are supplemented by the guided buggy activity participation contract, which all participants must read and sign before the activity begins, and which is provided to the customer in advance and available HERE.

2. Participation requirements

Drivers:

  • Minimum age: 25 years of age.
  • A valid category B driving licence, which must be presented in original form on the day of the activity. Photocopies and photographs are not accepted.
  • Only those identified as drivers in the participation contract may drive.
  • Driving will not be permitted to anyone under the influence of alcohol, drugs or medication affecting driving ability, or in a state of fatigue that compromises safety.

Passengers: people without a driving licence may take part, as may minors, always as passengers and never as drivers. Minors must be accompanied by their parent or legal guardian, who signs the contract on their behalf, and must use the approved child restraint systems required by traffic regulations, which the participant is responsible for providing.

Health: before setting off, participants must inform the organiser of any circumstance (illness, physical limitation, medical treatment) that may affect their ability to drive or take part safely.

Failure to meet these requirements on the day of the activity will prevent participation with no right to a refund, as these conditions are notified in advance.

3. Description of the service, places and timetable

  • Approximate duration: 2.5 to 4 hours of touring depending on the tour booked (includes the initial briefing and the closing tasting).
  • Maximum capacity per departure: 18 participants.
  • Time slots: Ruta Viña: 09:00–12:00 and 12:30–15:30. Ruta Sierra: 16:00–20:00, subject to availability and to the season.
  • Included: vehicle, fuel, accompanying guide, safety equipment, compulsory insurance and a tasting of local produce.
  • Not included: travel to the meeting point, suitable clothing and footwear, or any service not expressly stated.

Itineraries, places visited and tasting products may vary for reasons of safety, weather, the condition or availability of the tracks, administrative authorisations or the availability of local producers, without this altering the essential nature of the experience booked.

The organiser may set a minimum number of participants per departure. If this is not reached, the customer will be offered a change of date or time slot, or a full refund.

4. Booking process

  1. The customer selects the activity, the date, the time slot and the number of participants.
  2. They complete the requested details and expressly accept these Terms and the Privacy Policy.
  3. They review the order summary before confirming it, and may correct any input error.
  4. They make payment.
  5. They receive booking confirmation by email, which constitutes proof of the contract and includes the meeting point, the arrival time and equipment recommendations.

If confirmation is not received within a reasonable time, the customer should contact the organiser. The contract is formed at the moment LAGA confirms the booking. The language of the contract is [Spanish / Basque / English]. The contract document is filed electronically and the customer may request a copy at any time.

5. Prices and payment

Published prices are stated in euros and include applicable VAT, and are per buggy, not per person. The price in force will be the one shown on the website at the time of booking, save for manifest typographical error, in which case the customer will be informed before confirmation and may withdraw at no cost.

The organiser may require payment of 100% of the price before the activity begins, and may also require a deposit at the time of booking. Accepted means of payment are: credit/debit card, Bizum, Paypal and payment at the meeting point.

Card payments are processed through a secure payment gateway operated by the financial institution; LAGA never stores full card details.

An invoice will be issued at the customer’s request, provided that full tax details are supplied before the end of the activity.

6. Right of withdrawal

In accordance with Article 103(l) of Royal Legislative Decree 1/2007 (consolidated text of the General Law for the Defence of Consumers and Users), the 14-day right of withdrawal does not apply to contracts for services related to leisure activities where the contract provides for a specific date or period of performance.

As LAGA’s activities are booked for a specific date and time slot, the customer has no right of withdrawal. This is without prejudice to the cancellation and amendment policy set out in the following clause, which LAGA applies voluntarily and which is more favourable to the customer.

7. Cancellation and amendment of the booking

7.1. By the customer

Notice before the start timeConsequence
More than 7 daysFull refund or change of date at no cost
Between 3 and 7 daysChange of date at no cost, subject to availability, or a 50% refund
Less than 3 daysChange of date at no cost. No right to a refund
No-showNo right to a refund

Cancellation or amendment requests must be sent in writing to info@lagarioja.com, quoting the booking number. Refunds will be issued by the same means of payment used, within a maximum of 14 calendar days from acceptance of the cancellation.

If a participant arrives late at the meeting point and this prevents them from joining the group, it will be treated as a no-show. If they voluntarily leave the activity once it has started, no refund will be due.

7.2. By the organiser

If LAGA is obliged to cancel the activity for technical reasons, extreme weather, administrative restrictions, failure to reach the minimum number of participants or any other justified cause, it will notify the customer as far in advance as possible and will offer, at the customer’s choice:

  • a change to another available date or time slot, or
  • a full refund of the amount paid.

Where the cancellation affects only some participants due to places available or vehicle characteristics, the order of booking will apply.

Beyond these cases, the organiser will not cover indirect costs (travel, accommodation or others) that the customer may have incurred.

8. Weather and adaptation of the itinerary

The activity takes place outdoors. Customers must check the weather forecast and come with suitable clothing and footwear, at their own responsibility.

LAGA monitors weather conditions and the state of the tracks. Where these could compromise the safety of participants or the proper preservation of the rural tracks, the organiser may modify the itinerary in whole or in part, prioritising alternative routes or paved roads, or suspend the activity.

Itinerary changes made for these reasons once the activity has started do not give rise to a refund, as they form part of running the activity responsibly. Total suspension before the start is governed by clause 7.2.

9. Safety rules and the guide’s authority

All departures are led by a guide, whose instructions are binding and final in matters of safety. Participants undertake to:

  • Follow the marked route at all times, without taking shortcuts or unauthorised tracks, and without leaving the tracks and trails of the itinerary.
  • Keep a safe distance and a speed suited to the terrain, with no overtaking, racing, deliberate drifting or reckless driving.
  • Respect the right of way of farm machinery, local residents and other users of the tracks, and not discard waste in the surroundings.
  • Use the safety equipment provided and keep seatbelts fastened throughout the tour.

Breach of these rules entitles the guide to remove the participant from the activity immediately, with no right to a refund, without prejudice to liability for any damage caused.

10. Insurance and liability

The vehicles are covered by compulsory third-party liability insurance and additional cover, and the activity carries the accident cover for participants required by applicable regulations. Full policy conditions are available on request.

Participants are liable for damage caused to the vehicle or to third parties through their negligence, improper use or failure to follow instructions, on the terms set out in the participation contract. The driver and the person contracting the activity are jointly and severally liable.

LAGA is not liable for the loss, theft or damage of participants’ personal belongings during the activity.

The organiser’s liability under the contract is limited, to the extent permitted by law, to the price of the activity booked. This limitation does not apply to damage caused by wilful misconduct or gross negligence on the part of the organiser, nor to damage to life, physical integrity or health, nor to any other case where consumer legislation does not allow limitation.

11. Gift vouchers

Gift vouchers are valid for [12] months from the date of issue, are personal or bearer vouchers as indicated, cannot be exchanged for cash, and must be redeemed by prior booking subject to availability. Once the validity period has expired without use, [the right to redeem is lost / an extension may be requested].

12. Complaints and dispute resolution

Customers may address any complaint to info@lagarioja.com or to the postal address given in clause 1. LAGA will acknowledge receipt and reply as soon as possible.

ERROA EXPERIENCE, S.L. holds official complaint forms in accordance with the consumer regulations of the Autonomous Community of the Basque Country, available to customers at the activity meeting point. Customers may also contact Kontsumobide — the Basque Consumer Institute or the relevant Municipal Consumer Information Office.

Consumers resident in another EU Member State may contact the European Consumer Centres Network (ECC-Net).

13. Amendment of these Terms

LAGA reserves the right to amend these Terms. The Terms applicable to each booking will be those in force and accepted at the time the booking is made.

14. Severability

A declaration that any of these clauses is void will not affect the validity of the remainder, which will continue in full force.

15. Governing law and jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts with jurisdiction under applicable law; where the customer is a consumer, the courts of their place of residence will have jurisdiction.
