Access to the website is free of charge, save for the cost of the connection through the telecommunications network supplied by the user’s access provider.

Browsing the website confers the status of user and implies full and unreserved acceptance of each and every provision of this Legal Notice, of the Privacy Policy and of the Cookie Policy. Users who do not agree with their content should refrain from using the site.

The contracting of activities is additionally governed by the General Terms and Conditions of Booking and by the guided buggy activity participation contract, signed before the activity begins.

3. Terms of use

The user undertakes to make diligent, proper and lawful use of the website and, in particular, not to use it in order to:

  • Carry out unlawful or illegal activities, or activities contrary to good faith and public order.
  • Disseminate content or propaganda of a racist or xenophobic nature, pornography, apologia for terrorism, or material that infringes human rights.
  • Introduce computer viruses, malicious code or any other system that may cause damage to the owner’s systems or to those of third parties.
  • Attempt to gain unauthorised access to restricted areas, to other users’ accounts or to the owner’s systems.
  • Systematically extract, reproduce or reuse the content of the website (including texts, photographs, videos and tour descriptions), whether manually or by automated means (scraping, bots and similar), without express written authorisation.
  • Impersonate third parties or provide false information in the forms on the site.

The user is solely responsible for the truthfulness and accuracy of the information they provide and will be liable for any damage caused by improper use of the website.

4. Intellectual and industrial property

All content on the website — including, by way of example and without limitation, texts, photographs, videos, illustrations, tour descriptions, maps, graphic design, source code, navigation structure, databases and logos — is owned by ERROA EXPERIENCE, S.L. or by third parties who have authorised its use, and is protected by Spanish and EU intellectual and industrial property law.

The name Lagarioja, the strapline “Ride The Land” and the associated distinctive signs, logos and visual identity constitute trade marks and industrial property, and their unauthorised use is expressly prohibited.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the content of the website is prohibited without the owner’s prior written authorisation. Access to the website does not grant the user any ownership rights over that content.

Users are authorised to view, print and partially download content solely for their own personal and private use, on a non-commercial basis.

Third-party trade marks, trade names and logos that may appear on the site (partners, wineries, accommodation providers, local producers, vehicle or equipment manufacturers) belong to their respective owners, and their appearance does not imply sponsorship, endorsement or any relationship other than that expressly stated in each case.

5. Content, photographs and availability of information

The photographs, videos and descriptions published are illustrative of the type of experience offered. The specific itineraries, the places visited, the vehicles assigned and the tasting products may vary depending on availability, weather conditions, the state of the tracks, the administrative authorisations in force and the decisions taken by the guide on grounds of safety or conservation of the environment.

The owner endeavours to ensure that the information published (prices, timetables, durations, participation requirements) is accurate and up to date, but cannot guarantee the absence of typographical errors or omissions. Where a manifest error is detected in a price or in an essential condition, the owner reserves the right to correct it and to inform the user before confirming the booking, and the user may withdraw from it at no cost.

6. Exclusion of liability

The owner does not guarantee the availability and uninterrupted operation of the website, the absence of errors in its content, or that such content is permanently up to date. To the extent permitted by applicable law, the owner excludes liability for damage of any kind arising from:

  • The unavailability, maintenance or failure of the website or its services to function properly.
  • The presence of viruses or malicious or harmful programs in the content, provided that the owner has adopted reasonable security measures.
  • Unlawful, negligent or fraudulent use by users, or use contrary to this Legal Notice.
  • The lack of truthfulness, accuracy or currency of the content of third-party websites accessible through links.

These exclusions do not affect the rights that consumer legislation grants on a mandatory basis, nor cases of wilful misconduct or gross negligence.

7. Links

Outbound links. The website may contain links to third-party pages (wineries, accommodation providers, restaurants, local producers, tourist offices, social media or booking gateways). The owner exercises no control over those sites and accepts no responsibility for their content, privacy policies or business practices. The inclusion of a link does not necessarily imply any relationship, partnership or endorsement.

Inbound links. Establishing a link to this website does not imply any relationship between the owner and the owner of the linking site, nor acceptance or approval of its content. Reproduction of the content, whether in whole or in part, and use of the owner’s trade marks on the linking site are not authorised without express permission.

8. Data protection and cookies

The processing of users’ personal data is governed by the Privacy Policy, and the use of cookies and similar technologies by the Cookie Policy, both permanently accessible from the footer of the website.

9. Amendment of the Legal Notice and of the website

The owner reserves the right to amend this Legal Notice at any time and without prior notice, as well as the presentation, configuration and content of the website, in order to adapt them to legislative developments, changes in the business or technical improvements. Amendments take effect from the moment they are published, so users are advised to consult this page periodically.

10. Severability

If any clause of this Legal Notice is declared void or ineffective, that declaration will not affect the validity of the remaining clauses, which will remain in full force.

11. Governing law and jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the website, the parties submit to the courts with jurisdiction under applicable law.
